Welcome to The Lomm Labs, operated by Vaibhava Lakshmi Distributors, a company incorporated under the laws of India, having its registered office at Mumbai (“Company”, “we”, “us”, or “our”).

These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, and related services (collectively, the “Services”).

By accessing, browsing, registering on, or using the Platform, or by purchasing any product through the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use the Platform.

1. Eligibility

3. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, prices, availability, colours, sizes, and other information displayed on the Platform are accurate.

However:

  • Product colours may vary depending on your device or screen;

  • Images may be for illustrative purposes;

  • Minor variations in appearance, packaging, measurements, or specifications may occur;

  • Product availability may change without notice; and

  • We do not guarantee that every product description or other Platform content will always be error-free.

If a product is listed with an incorrect price or material error, we reserve the right to cancel the relevant order and provide an appropriate refund where applicable.

4. Product Availability

Products displayed on the Platform are subject to availability.

Adding a product to your cart does not guarantee that the product will remain available until checkout or payment.

We reserve the right to limit quantities purchased by a customer, household, account, or transaction where reasonably necessary, including to prevent fraud, resale, abuse, or other misuse of the Platform.

5. Orders

When you place an order, you are making an offer to purchase the selected products.

After placing an order, you may receive an order acknowledgement. This acknowledgement does not necessarily mean that your order has been accepted.

An order is considered accepted when we confirm the order for fulfilment or dispatch, unless otherwise stated.

We reserve the right to refuse or cancel an order for reasons including:

  • Product unavailability;

  • Incorrect product or pricing information;

  • Payment failure;

  • Suspected fraud or unauthorized activity;

  • Violation of these Terms;

  • Delivery limitations;

  • Duplicate or unusually large orders; or

  • Other legitimate operational or legal reasons.

If we cancel an order after payment has been received, we will process the applicable refund in accordance with our refund policy.

6. Pricing and Taxes

Prices displayed on the Platform are stated in Indian Rupees (INR), unless otherwise specified.

Applicable taxes, including GST where applicable, will be charged in accordance with applicable law.

Shipping, delivery, handling, or other charges, if applicable, will be displayed before you complete your purchase.

We reserve the right to change prices at any time. A price change will not affect an order that has already been accepted, except where required to correct an obvious error or as otherwise permitted by law.

7. Payments

Payments may be processed through third-party payment service providers.

By submitting payment information, you authorize the applicable payment provider and/or Company to process the transaction for the amount displayed at checkout.

We may support payment methods including:

  • Credit and debit cards;

  • UPI;

  • Net banking;

  • Digital wallets;

  • Cash on delivery, where available; and

  • Other payment methods made available on the Platform.

We do not generally store complete payment-card information on our own systems where payment processing is handled by a third-party payment provider.

You must not use a payment method that you are not authorized to use.

We reserve the right to cancel or hold an order if a payment is suspected to be fraudulent, unauthorized, or otherwise irregular.

8. Shipping and Delivery

We will make reasonable efforts to deliver products within the estimated delivery period displayed at checkout or communicated to you.

Delivery timelines are estimates and may be affected by factors outside our reasonable control, including:

  • Weather;

  • Natural disasters;

  • Transportation disruptions;

  • Strikes;

  • Government restrictions;

  • Address-related issues;

  • Logistics-provider delays; or

  • Other unforeseen circumstances.

You are responsible for providing an accurate and complete delivery address and contact information.

If delivery fails because incorrect or incomplete information was provided by you, or because you are unavailable to receive the shipment, additional delivery charges may apply where permitted.

9. Returns, Exchanges and Refunds

Returns, exchanges, cancellations, and refunds are subject to our Return and Refund Policy, which forms part of these Terms.

The applicable policy may specify:

  • Non-returnable products;

Orders that have already been dispatched may not be eligible for cancellation and may instead be subject to the applicable return process.

We reserve the right to cancel orders in accordance with these Terms and applicable law.

From time to time, we may offer promotional codes, discounts, loyalty benefits, cashback, contests, or other promotional offers.

Each promotion may be subject to additional terms.

Promotional offers:

  • May have limited validity;

  • May be limited to specified products or customers;

You remain responsible for your User Content.

By submitting User Content, you represent that:

  • You own or have the necessary rights to submit it;

  • It does not infringe another person's intellectual property, privacy, or other rights;

  • It is not unlawful, misleading, defamatory, abusive, obscene, or fraudulent; and

  • It does not contain malicious code or harmful software.

By submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, modify, and distribute that User Content for operating, improving, marketing, and promoting the Platform, subject to applicable law and our Privacy Policy.

We may remove User Content that violates these Terms or applicable law.

13. Reviews and Ratings

Reviews and ratings should reflect your genuine experience with the relevant product.

You must not:

  • Submit fake reviews;

  • Manipulate ratings;

  • Review products you have not reasonably experienced;

  • Post reviews in exchange for undisclosed compensation;

  • Impersonate another person; or

  • Use reviews to advertise unrelated products or services.

We may moderate, remove, or decline to publish reviews that violate these requirements.

14. Intellectual Property

All content and materials available through the Platform, including:

  • Logos;

  • Brand names;

  • Product images;

  • Photographs;

  • Graphics;

  • Designs;

  • Text;

  • Software;

  • User interfaces;

  • Videos;

  • Audio;

  • Website and application design; and

  • Other materials

are owned by or licensed to the Company and are protected by applicable intellectual property laws.

You may use the Platform only for personal and lawful purposes.

You must not copy, reproduce, modify, distribute, sell, license, reverse engineer, scrape, or commercially exploit Platform content without our prior written permission, except where such use is permitted by applicable law.

15. Prohibited Uses

You must not use the Platform to:

  • Commit fraud or other unlawful activity;

  • Impersonate another person;

  • Create fake accounts;

  • Attempt to gain unauthorized access to accounts or systems;

  • Interfere with Platform security;

  • Introduce malware, viruses, or harmful code;

  • Scrape or systematically extract Platform data without authorization;

  • Use automated systems to purchase products for resale or to circumvent purchasing limits;

  • Manipulate reviews, ratings, promotions, or pricing;

  • Attempt to exploit technical vulnerabilities;

  • Use another person's payment information without authorization;

  • Circumvent security or access controls; or

  • Otherwise misuse the Platform.

16. Third-Party Services

The Platform may integrate with or contain links to third-party services, including payment providers, logistics providers, authentication providers, analytics services, social-media platforms, and other third parties.

Third-party services are governed by their own terms and privacy policies.

We are not responsible for the availability, security, content, or practices of third-party services except to the extent required by applicable law.

17. Privacy

Our collection, use, storage, and processing of personal information is governed by our Privacy Policy.

By using the Platform, you acknowledge that you have read and understood the Privacy Policy.

18. Electronic Communications

By using the Platform, you consent to receiving electronic communications from us, including communications relating to:

  • Orders;

  • Payments;

  • Delivery;

  • Returns;

  • Account activity;

  • Customer support;

  • Security;

  • Service updates; and

  • Other transactional matters.

Where permitted by applicable law, we may also send promotional communications subject to your applicable communication preferences and consent requirements.

20. Disclaimer

We do not guarantee that:

  • Platform content will always be accurate or complete;

  • Products will always be available;

  • The Platform will be completely free from errors or interruptions; or

  • Defects will always be corrected immediately.

Nothing in these Terms excludes or limits any consumer rights or statutory protections that cannot lawfully be excluded or limited.

21. Limitation of Liability

To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of the Platform.

Our liability will not be excluded or limited where doing so would be prohibited under applicable law.

Nothing in these Terms limits liability for fraud, wilful misconduct, or other liability that cannot legally be excluded or limited.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless the Company, its affiliates, directors, officers, employees, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your violation of these Terms;

  • Your unlawful use of the Platform;

  • Your User Content;

  • Your infringement of another person's rights; or

  • Your fraudulent or unauthorized activity.

This provision will apply only to the extent permitted by applicable law.

23. Suspension and Termination

We may suspend or terminate your access to the Platform if we reasonably believe that:

  • You have violated these Terms;

  • Your account is being used fraudulently;

  • Your activity creates a security or legal risk;

  • Your account is being used to abuse promotions or services; or

  • Suspension or termination is otherwise required by law.

Termination will not affect rights or obligations that arose before termination.

24. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may provide appropriate notice through the Platform, email, or other legally permitted means.

The updated Terms will become effective on the date specified in the updated Terms.

Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

25. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Nothing in these Terms limits any mandatory consumer rights or remedies available to you under applicable law.

Where a dispute cannot be resolved through customer support, it will be handled in accordance with applicable Indian law and the dispute-resolution mechanisms available under applicable law.

Any jurisdiction clause contained in these Terms will be subject to applicable consumer-protection laws and any mandatory jurisdiction or remedy available to consumers.

28. Force Majeure

We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, pandemics, war, civil unrest, government actions, strikes, telecommunications failures, infrastructure failures, or major disruptions affecting logistics, payment systems, or technology providers.

29. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to remain in effect to the extent permitted by law.

30. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any applicable promotional or product-specific terms, constitute the agreement between you and the Company regarding your use of the Platform.
